Terms and conditions

1. Who are we?

2. What do these terms apply to?

To every use of our website and every order in our webshop. By placing an order, you accept these terms. Rights that the law grants only to consumers apply only to consumers. How we handle your personal data is explained in our privacy policy.

3. Ordering and payment

You must be 18 or older to place an order. Your order is final as soon as we confirm it by email, after your payment has been approved. You pay in advance, using one of the payment methods offered at checkout.

We may refuse or cancel an order, for example in the event of suspected fraud or misuse, an order placed by a minor, an obvious pricing error, or if the product is no longer available. In that case, we will refund anything you have already paid.

4. Prices

Prices in the webshop include VAT and exclude shipping costs. You will see the shipping costs and the total price before you pay. Obvious pricing errors are not binding on us. For deliveries outside the European Union, import duties and taxes may be due; these are at your expense, unless we indicate otherwise at checkout.

Product photos and descriptions are as accurate as possible; minor differences in colour or packaging are not a defect.

5. Delivery

We deliver to the address you provide, in the countries you can select at checkout. We aim to deliver quickly; the delivery times on our website are indicative. If you have not received your order within 30 days of our confirmation, you can give us a reasonable additional period and then cancel the order if it has still not been delivered.

The risk of loss or damage passes to you as soon as you (or someone you have designated for that purpose) take receipt of the products. Check your parcel on receipt and report any damage or delivery error as soon as possible via hello@rayskincare.com.

6. Right of withdrawal (consumers only)

You can withdraw from an order without giving any reason within 14 days of the day on which you receive the products. Let us know within that period via hello@rayskincare.com or using the form below. Then return the products within 14 days to Ray Care BV, Veldstraat 62, 9000 Ghent, Belgium. The cost of returning the products is at your expense.

The right of withdrawal does not apply to sealed products that are not suitable for return for reasons of hygiene or health protection once the seal has been broken, nor to products made or personalised to your specifications.

You may only inspect and handle the products as you would in a shop. If their value has diminished because you went beyond that, we may deduct that diminished value from the refund.

We will refund you within 14 days of receiving the products back or of you proving that you have sent them. We will use the same payment method as for your order. If you chose a more expensive delivery method than our standard delivery, we will only refund the cost of standard delivery.

7. Warranty

As a consumer, you are entitled to the two-year legal guarantee for defects that already existed at the time of delivery. Report a defect as soon as possible via hello@rayskincare.com, with your order number and a description or photo. Defects caused by normal wear and tear, incorrect use, incorrect storage or use after the expiry date are not covered by the guarantee.

8. Liability

Our liability for an order is limited to the price you paid for that order. We are not liable for indirect damage, such as loss of income or loss of data. We do not guarantee that the website will always be available and free of errors.

These limitations do not apply to damage caused by our intent or gross negligence, to personal injury or death, or to anything the law mandatorily prescribes, such as the legal guarantee and product liability.

9. Intellectual property and reviews

All content on our website (texts, photos, videos, logos, designs, software) is the property of Ray or our licensors. You may not copy or use it without our written permission, except for your own non-commercial use.

If you post a review, photo or other message on our website or via our channels, we may use it free of charge and without time limit in our communication and marketing, including in edited form. You warrant that you have the right to do so and that your message is not unlawful, misleading or offensive. We may refuse or remove messages that violate these terms.

10. Force majeure

If we are unable to fulfil an obligation due to circumstances beyond our control (such as strikes, failure of suppliers or carriers, or outages of networks or the webshop), that obligation is suspended for as long as the force majeure lasts. If it lasts longer than 30 days, either party may cancel the order and we will refund what you paid.

11. Complaints and disputes

If you have a complaint, email hello@rayskincare.com and we will find a solution together. As a consumer, you can also contact the Belgian Consumer Ombudsman Service, www.consumerombudsman.be.

These terms are governed by Belgian law. Disputes will be submitted to the courts of Ghent, unless the law mandatorily designates another court.

12. Final provisions

If any provision of these terms is invalid, the other provisions remain in force and the invalid provision is replaced by a valid one that comes as close to it as possible. We may amend these terms; an order is governed by the version on the website at the time the order is placed.
